Terms of Service (TOS)Agreement to TermsBy purchasing an art piece, you ("the Purchaser") agree to the following Terms of Service ("TOS") of Skye, also known as SakuraSkyes (“the Artist’’).Please read these terms carefully before making a purchase.

GENERAL TERMS
1. Refunds
All sales are final, and no refunds will be provided unless the incorrect amount is sent.
2. Payment
a. Payment is exclusively accepted through PayPal Invoice for all art pieces, including commissions and premade work.
b. The art will only be delivered upon receiving full payment.
3. Copyright and Usage
a. The artist retains full rights to all artwork, including the right to use, create copies, and post all creations on their social media platforms, including for advertisements.
b. The artist reserves the right to revoke ownership of their artwork at their discretion. If the purchaser breaches any terms or engages in harmful behavior towards the artist. Ownership will be revoked, and the offender will be blacklisted.
c. Purchasers may not claim the artist's work as their own or use it for commercial purposes unless they have purchased through a commercial use option.
d. It is necessary to include a text or watermark on all art unless it has been purchased for commercial use with proper licensing or permission.
e. Using the art as an original character is permitted, provided proper credit is given for the character's original design. Crediting should appear as Original art and design by ©sakuraskyes.com
4. Art Integrity
a. Purchasers are prohibited from editing the artist's work in any way, including repainting, removing text, or recoloring.
b. Unfinished Pieces (WIPs) cannot be preclaimed, but interested parties may request notifications when the finished version is posted in the artist's Discord channel.
5. Holds and Payment
a. Full payment must be received within 24 hours unless a hold has been accepted by the artist.
b. Holds must be mentioned in the initial claiming post for an art piece.
c. Holds are available for a maximum of 72 hours. Failure to make payment within this timeframe will result in the art becoming available again for purchase without notice, and future hold requests may not be honored in the future.
d. After purchasing an art piece, the Purchaser must wait at least 30 days before attempting to resell it.AUCTIONS
Payment must be sent within 24 hours. There are no holds for auction pieces, do not place a bid unless you have the full amount of funds.
1. Payment plans
a. Payment plans are available for pieces priced at $150 or more.
b. A non-refundable down payment of at least $50 must be sent within 24 hours; failure to do so will result in the piece becoming available to the next highest bidder.
c. Payment plans require weekly payments of at least $100 until the full payment is fulfilled.
d. Failure to pay the payment plan will result in a refund without the initial down payment, and the art will become available for purchase once again.
2. Bidding
a. Only bid if you are serious, ready to pay within 24 hours, and have the full amount of your bid ready unless I've accepted a payment plan which must be stated in the initial bid itself not after the auction has commenced.
b. Make sure to reply to the bid above yours in the thread.
c. If you back out of your bid, you will be unable to bid for the next 2 auctions that take place. If you continuously delete your bids you will be blacklisted from all future auctions.
d. You must bid within the bidding thread; DM bids are not allowed.
3. The Auction
a. Autobuy will be revealed 8 hours after the piece has been posted.
b. If the auction is not bid upon, the piece will be put back up as a premade.
c. There will be a list of bidding history, in case someone deletes their bid. (I'll notice if you delete it; please reach out to me if you need to back out so I can remove it).
d. Auctions end 48 hours after the first bid. If someone bids within the final 10 minutes, the auction will be extended for another 30 minutes.
COMMISSIONS
1. Client Agreement
a. By commissioning artwork from the artist. (You), the client acknowledges and agrees to abide by these Commission Rules. This agreement is legally binding and serves as a contract between the artist and the client.
2. Alterations
a. Major changes to the commissioned piece can be made after the first work-in-progress, while minor changes can be made after the second.
b. Changes can be requested at three points during the process, the first work-in-progress, the second, and any animation adjustments, after which the final piece will be sent.
c. No further alterations will be made after the final piece is sent.
d. All commissioned art is for personal use unless commercial use has been explicitly discussed and agreed upon.
e. Commercial use will entail 250% of the original cost.
3. No Rushed Commissions:
a. Completion date is subject to change. Each piece receives equal care and attention to detail, and completion may take around 30 days.
Wait-List:
a. When a commission slot opens up, I go through the waitlist in order of forms submitted first.
b. If I haven't received your form within 48 hours of my request, your slot will be made available for others to claim.
4. Payment:
a. Failure to pay within 72 hours after the first work-in-progress will result in the forfeiture of your commission slot. In such cases, the artwork will undergo significant alterations and be repurposed as a completely different premade piece.
4. General Information
a. The artist is open to drawing light NSFW content and moderate gore/blood.
b. The artist reserves the right to decline a commission if it makes them uncomfortable.
c. Providing details and specifics, along with visual references, is highly appreciated to ensure the best possible outcome.
d. Clients can expect a waiting period of approximately one to two weeks once started for the finished piece, as the artist dedicates all her care to each of her creations.
e. If the artist is not accustomed to drawing a particular subject, they will communicate this before accepting the commission, but they will make their best effort.
f. The artist will not draw anything outside of their offered styles.
g. The artist will not create artwork that is offensive or contains hate speech.
h. The artist will not produce art that is extremely repulsive.
i. The artist will not engage in drawing anything that is illegal or involves aged-up characters.
PREMADES
1. Client Agreement
By claiming and purchasing a premade artwork, you acknowledge and agree to adhere to these Premade Information and Claiming Rules. This agreement is legally binding and establishes a contractual relationship between the artist (you) and the client.
2. Payment
a. Payment must be submitted within 24 hours; otherwise, the piece will become available for purchase again unless a hold for up to 72 hours has been accepted.
3. Claiming a Premade
a. Claims are based on a random selection, determined by spinning a wheel unless three people claim within one hour of the post. In such cases, the piece will be converted to an auction.
b. Only claim a premade if you genuinely intend to purchase it.
c. Specify in your claim post if you need the piece to be held for up to 72 hours.
d. If your claim is accepted, make sure to DM the form below.
e. To claim, simply post "claim" in the thread below the artwork, even if others have claimed before you.
f. You still have a chance if other claims are received.

TEXT CHANGES, TRADES, AND RESELLS
1. General Rules
a. Fill out either of the forms below and post it in the Trading or Reselling channels.
b. A $10usd text change fee applies to resales. The responsible party for this fee can make the payment here: https://paypal.me/sakuraskyes.
c. Do not resell any of my art for** 30 days** after it is purchased or resold.
d. Inform me of the new buyer's username so I can keep track of ownership, you can DM me for this. Resells will be sent directly to the new owner of the piece.
e. If you are reselling from another artist, it is your responsibility to obtain permission from the artist to resell their work.
f. Any transactions, other than those initiated by myself, are undertaken at your own risk. Therefore, I kindly request all Floofs to trade, buy, and sell with caution. ♥Trading Form

1. Respectful Behavior
a. Be kind to one another. Bullying or harassment is strictly prohibited.
b. Keep discussions free from offensive topics, such as vulgar, sexual, racist, homophobic, or slanderous content.
c. Discrimination of any kind will not be tolerated.
2. Regarding NSFW
a. My artwork may have suggestive themes. All art channels are restricted to individuals aged 18 and above.
b. Any NSFW content that exceeds suggestive or mildly sexual themes must be marked with the /spoiler command.
c. You must provide appropriate content warnings to maintain a welcoming environment for everyone.
3. Questions and Concerns
a. Use the designated questions channel for inquiries or concerns. For personal matters, feel free to send a private message.
4. Spam and Misuse
Avoid spamming and ensure content is posted in the correct channels. Do not use @everyone or @here.
5. Art Theft Policy
Copying, stealing, modifying, or tracing anyone's artwork posted in this server is strictly prohibited. Violators will be banned.
By participating in this server, you automatically accept and agree to these rules and my Terms of Service (T.O.S.). This agreement extends to any future alterations or T.O.S. modifications.
6. Client Acknowledgment
All individuals joining this server acknowledge and agree to comply with these rules. This acknowledgment is legally binding and establishes a contractual agreement between the server owner and its members.
Modification of Terms
These terms of service are subject to change without prior notice. It is the responsibility of the Purchaser to review and understand the current terms before making a purchase.
